Legal considerations

Heightened care. Verify title and authority, permitted use, zoning/occupancy/fire and business permits, tax registration and invoices, EWT/Form 2307, DST, CAM, fit-out, mortgagee/building consents, public-document or registry requirements, and lawful judicial recovery of possession.

How it is signed

Acknowledged before a notary public. You sign, then appear before a notary public who checks your identity and confirms that you signed freely (an acknowledgment). This is the form usually needed for documents that will be registered.

How to complete your Commercial Lease Agreement

The guided interview takes you through 8 steps. The document updates as you answer, and some questions appear only when your earlier answers make them relevant.

  1. Step 1

    Confirm the commercial-property route

Commercial premises are not governed by the residential rent-control interview. Actual use and location determine permits, building, fire, health, environmental, and special-property requirements.

    Up to 7 questions
  2. Step 2

Verify the parties, title, and signing authority

A polished lease is worthless if the lessor cannot grant possession or an entity representative lacks authority.

    Up to 16 questions
  3. Step 3

Define exactly what is being leased

Use a plan and condition report. State included areas, fixtures, access, use, exclusions, liens, and permit responsibility.

    Up to 13 questions
  4. Step 4

Set turnover, term, rent, tax, and deposit mechanics

Separate turnover, lease start, rent commencement, and expiry. State VAT and withholding based on verified tax status and calculate DST from the actual schedule.

    Up to 27 questions
  5. Step 5

Control renewal, holdover, CAM, utilities, and taxes

Prevent surprise costs by defining CAM exclusions and reconciliation, then separately allocate utilities, property tax, DST, notarization, and registration.

    Up to 20 questions
  6. Step 6

Design fit-out, repairs, safety, and restoration

Commercial fit-out should identify plans, permits, contractors, liens, ownership, removal, restoration, maintenance, urgent repairs, inspection, and rent relief.

    Up to 11 questions
  7. Step 7

Set operating, transfer, casualty, and risk rules

The lease should survive real events: access credentials, business transfers, building sale or foreclosure, damage, closures, insurance claims, and third-party claims.

    Up to 12 questions
  8. Step 8

Handle default, surrender, notices, and execution lawfully

State balanced cure routes and preserve the demand and judicial possession process. Do not turn a contract clause into an unsupported lockout or seizure power.

    Up to 16 questions
