What is a Last Will and Testament?

A Last Will and Testament is a written declaration of how a person's property is to pass after their death.

What this template does. Prepare a Philippine notarial-will execution draft or holographic handwriting master after strict capacity, heir, legitime, ownership, witness, form, custody, and probate routing.

Legal considerations

Formalities required. Independent Philippine succession-lawyer review remains mandatory before execution; a holographic download is only a copying master, while a notarial draft must be finally paginated and executed in one strict testator/witness/notary ceremony before it can be offered for probate.

How it is signed

Strict formalities. A will must follow the form the law requires, including how the testator and the witnesses sign. A will that misses a formality can fail entirely, so follow the signing steps exactly.

What it draws on

  • Civil Code on wills and succession
  • Rules of Court on probate
  • Supreme Court will jurisprudence
  • Traditional Notarial Rules
  • Electronic-execution exclusions

The exact provisions, with links to the official text, are listed under the Philippine law behind it.

How to complete your Last Will and Testament

The guided interview takes you through 9 steps. The document updates as you answer, and some questions appear only when your earlier answers make them relevant.

  1. Step 1

    Confirm testamentary capacity

A will is strictly personal. The testator must be at least eighteen, understand the act and estate, and act free from pressure or substituted instructions.

    Up to 6 questions
  2. Step 2

    Choose the legally distinct form

A notarial will uses three witnesses and a notarial acknowledgment. A holographic will must be entirely handwritten, dated, and signed by the testator.

    Up to 7 questions
  3. Step 3

Identify the testator and property regime

A married testator can dispose only of separate property and the testator's share in community or conjugal property—not the spouse's share.

    Up to 9 questions
  4. Step 4

    Audit compulsory heirs

Philippine legitimes restrict the disposable portion. Omission of a direct-line compulsory heir can annul the institution of heirs through preterition.

    Up to 14 questions
  5. Step 5

    Map the disposable estate

Identify ownership and liabilities before giving percentages. A will cannot dispose of another person's share or bypass secured claims, taxes, or valid business instruments.

    Up to 8 questions
  6. Step 6

    Write gifts and the residue

Specific gifts must identify the asset and recipient. Everything left after valid gifts, debts, charges, and legitimes should pass through a complete residuary plan.

    Up to 10 questions
  7. Step 7

    Choose administration and care roles

The probate court appoints the executor and decides authority and bond. A guardian nomination is relevant evidence but does not displace the child's best interests or court authority.

    Up to 13 questions
  8. Step 8

    Build the execution ceremony

The downloaded text is not a valid will until every formality for the selected route is completed exactly.

    Up to 19 questions
  9. Step 9

Protect the original and probate path

Only the original executed will should be treated as the operative document. It still must be proved and allowed by the proper probate court.

    Up to 2 questions

Last Will and Testament

Republic of the Philippines · Notarial execution draft · Template v0.2.0

DECLARATION

I, Maria Luz Santos, Filipino, of legal age, domiciled at Makati City, Philippines and residing at 100 Ayala Avenue, Makati City 1226, declare this instrument, written in English, a language known to me, to be my Last Will and Testament.

I make this Will personally, with testamentary capacity and intent, free from force, fear, fraud, mistake, and undue influence. I understand the nature of my estate, the persons who may properly inherit from me, and that this Will takes effect only upon my death and allowance by the proper court.

I revoke all wills and codicils previously made by me, if any.

FAMILY RECORD AND INSTITUTION OF COMPULSORY HEIRS

My family and potential compulsory-heir record is: Spouse: Juan Reyes Santos, living; legitimate child: Ana Reyes Santos, living; legitimate child: Leo Reyes Santos, living; no other known child or represented branch after record review

The audit presently records 2 living legitimate child/children, 0 adopted child/children, 0 child/children whose filiation/status requires review, spouse-survival status applicable, descendant representation not presently identified, and legitimate-parent/ascendant succession not presently applicable.

I institute as my heirs, each to the full legitime the law reserves to that heir, my compulsory heirs, namely: Juan Reyes Santos, spouse; Ana Reyes Santos, legitimate child; Leo Reyes Santos, legitimate child. I likewise institute to the legitime the law reserves to that heir any compulsory heir born, conceived, adopted, or legitimated after this Will is executed, and, by right of representation where the law allows it, the descendants of any compulsory heir who dies before me. The free portion and the residue are disposed of below.

Every disposition below is subject to compulsory heirs' legitimes, representation, preterition, reduction of inofficious gifts, collation, incapacity, and other mandatory Philippine succession rules.

ESTATE, DEBTS AND OWNERSHIP LIMIT

My material estate record is: Condominium title in Makati City, bank deposits, listed shares, household property, and a privately held business interest, all subject to ownership verification

My separate property is described as: Pre-marriage condominium interest and inherited personal property, subject to title and source review. Community or conjugal property and my estimated share are: Bank deposits and household property acquired during marriage; only the testator's net share is disposed of. I dispose only of property and transmissible rights belonging to me at death, including after-acquired property to the extent lawfully covered, and never another person's share.

My lawful debts, taxes, final expenses, secured claims, and estate-administration charges shall first be paid or provided for as law requires. The current record is: No known debts beyond ordinary final expenses and taxes to be verified by the executor.

SPECIFIC GIFTS

I make no specific devise or legacy in this draft; all distributable property passes under the residuary clause.

RESIDUARY ESTATE

After the preceding lawful charges, valid specific gifts, and compulsory heirs' legitimes, I give the entire distributable residue of my estate as follows: 50% to Ana Reyes Santos; 50% to Leo Reyes Santos.

If a voluntary beneficiary predeceases me, renounces, or is incapable of inheriting, I direct: If either named child predeceases me, that beneficiary's descendants take by branch, subject to representation and legitime review; otherwise the share accrues to the other named child

EXECUTOR AND ADMINISTRATION

I nominate Juan Reyes Santos, of 100 Ayala Avenue, Makati City 1226, as executor, and Ana Reyes Santos if the first nominee cannot or will not serve. The probate court retains authority to appoint, issue letters, determine qualification, require bond, and supervise administration.

I leave bond entirely to the probate court.

No separate digital-asset direction is included; the executor should inventory and handle transmissible digital interests only through lawful access and provider processes.

SEVERABILITY AND PROBATE

If a particular disposition is invalid or reduced, the remaining provisions should be given effect to the fullest extent Philippine law permits, without impairing compulsory heirs' rights. No property passes under this Will unless and until the Will is proved and allowed in the proper court.
