Legal considerations

Formalities required. Movable and immovable donations have different formalities; taxes, legitime, marital property, acceptance, and title require review.

How to complete your Deed of Donation

The guided interview takes you through 6 steps. The document updates as you answer, and some questions appear only when your earlier answers make them relevant.

  1. Step 1

    Choose what is being donated

The formalities depend on the kind of property. Real property needs a public instrument, and a gift that takes effect only on death is not a donation.

    Up to 2 questions
  2. Step 2

    Identify the Donor

Only the owner can donate, and only within the limits the law sets to protect the donor's spouse, creditors, and compulsory heirs.

    Up to 13 questions
  3. Step 3

    Identify the Donee

The Donee must accept. A minor or an organization accepts through a representative.

    Up to 13 questions
  4. Step 4

    Describe the property

Be precise. Vague descriptions cause registration and tax problems.

    Up to 13 questions
  5. Step 5

    Set the terms

Conditions and reversion are optional. Costs and delivery should be clear.

    Up to 7 questions
  6. Step 6

    Sign and notarize

A notarized deed is essential for land and strongly advised for anything else. A deed donating land is signed before two witnesses so it can be registered.

    Up to 9 questions

DEED OF DONATION INTER VIVOS

Republic of the Philippines — Gift between living persons · Template v0.2.0

KNOW ALL PERSONS BY THESE PRESENTS:

This Deed of Donation Inter Vivos (the "Deed") is made on September 18, 2026 by and between Rosario T. Villanueva, of legal age, widowed, with TIN 123-456-789-000, residing at 21 Sampaguita Street, Brgy. Poblacion, Lipa City, Batangas 4217 (the "Donor"), and Carmela V. Villanueva-Reyes, of legal age, with TIN 234-567-890-000, residing at 9 Molave Drive, Tandang Sora, Quezon City 1116 (the "Donee").

Recitals

The Donor is the owner of the property described below. The Property formed part of the property of the Donor's former marriage. It was liquidated and given to the Donor in the following settlement: Deed of Extrajudicial Settlement of the Estate of the late Ernesto M. Villanueva with Adjudication dated 14 March 2024, notarized in Lipa City as Doc. No. 112, Page No. 23, Book No. IV, Series of 2024, published once a week for three consecutive weeks, and annotated on TCT No. T-123456 as Entry No. 45678 on 2 May 2024, by which the community property was liquidated and the whole lot was adjudicated to Rosario T. Villanueva with the written conformity of all the other heirs. Out of pure liberality and the Donor's regard for the Donee, the Donor's Daughter, the Donor wishes to donate that property to the Donee.

1. The donation

The Donor donates, transfers, and conveys to the Donee, as a gift between living persons, the following property (the "Property"): A residential lot with a one-storey house, together with all improvements on it. It is covered by Transfer Certificate of Title No. T-123456, registered with the Registry of Deeds of Lipa City, Batangas, located at 21 Sampaguita Street, Barangay Poblacion, Lipa City, Batangas 4217. Area: 240 square meters. Lot 5, Block 2, Psd-04-012345. Tax declarations: Land TD No. 016-00123; Improvement TD No. 016-00124. Liens and encumbrances: None.

Technical description, as it appears on the title: A parcel of land (Lot 5, Block 2 of the subdivision plan Psd-04-012345), situated in the Barangay of Poblacion, City of Lipa. Bounded on the NE., along line 1-2 by Lot 4; on the SE., along line 2-3 by Road; on the SW., along line 3-4 by Lot 6; and on the NW., along line 4-1 by Lot 12; containing an area of TWO HUNDRED FORTY (240) SQUARE METERS, more or less.

The parties declare the fair market value of the Property to be Three Million Five Hundred Thousand Pesos (PHP 3,500,000.00).

2. Nature of the gift and the Donor's protections

This is a donation inter vivos. It is not a gift that takes effect only on the Donor's death, and it is irrevocable except for the causes the Civil Code and this Deed allow.

The Donor states that the Donor keeps enough property or income to support the Donor and the relatives the Donor must support (Article 750); that the Property is presently owned by the Donor and no future property is donated (Article 751); that it does not exceed what the Donor could leave by will, so it does not impair the legitime of compulsory heirs (Article 752); and that the Donor has kept enough property to pay all debts the Donor owed before this donation, so it is not made in fraud of creditors (Article 759).

The Donor states that the Donor is the lawful owner of the Property with the right to donate it, and has disclosed above every lien and encumbrance known to the Donor.

3. Conditions and revocation

The donation is pure and unconditional.

The donation may be revoked or reduced only for the causes and within the periods the Civil Code provides, including Articles 752, 760, 764, and 765.

4. Acceptance

Carmela V. Villanueva-Reyes accepts this donation and thanks the Donor for it. The acceptance is made in this same Deed.

5. Delivery and ownership

The Donor delivers the Property to the Donee at the signing of this Deed.

Ownership passes to the Donee upon the Donor's knowledge of the acceptance (Civil Code, Articles 712 and 734). Registration with the Registry of Deeds is required to bind third persons (Presidential Decree No. 1529, Section 51); the Donor shall sign every document the BIR, the Registry of Deeds, and the assessor require for it.
