Residential Lease Agreement

Republic of the Philippines · Template v0.2.0

This Residential Lease Agreement (the “Lease”) is made on August 29, 2026 between Maria L. Santos, with notice address at 100 Ayala Avenue, Makati City 1226, as “Lessor,” and Juan Dela Cruz, with current address at 20 Session Road, Baguio City 2600, as “Lessee.”

The Lessor represents that the Lessor is the owner of the Premises and has authority to lease the Premises. The parties agree as follows.

1. Premises and residential use

The Lessor leases to the Lessee the apartment located at Unit 12A, Sampaguita Residences, Makati City 1226, described as Unit 12A with one parking slot P-12 and installed fixtures (the “Premises”). The Premises shall be used only as a private residence and for no unlawful, commercial, hazardous, or nuisance-causing purpose.

Approved residents: Juan Dela Cruz and Ana Dela Cruz. Occupancy shall not exceed 4 persons, subject to applicable law and reasonable building or subdivision rules disclosed to the Lessee.

2. Term; delivery and condition

The fixed term begins on September 1, 2026 and ends on August 31, 2027, unless earlier terminated under this Lease or applicable law. The Lessor shall deliver the Premises in a condition fit for the intended residential use and maintain the Lessee in peaceful and adequate enjoyment during the term, subject to the Lessee's obligations.

The parties shall sign an inventory and condition report at turnover. That report, including dated photographs if agreed, forms part of this Lease.

3. Rent and payment

Monthly rent is ₱10,000.00, due in advance on or before day 5 of each month, paid by bank transfer to the account designated by the lessor in writing. The Lessor shall provide a written or electronic acknowledgment sufficient to identify the period and amount paid.

No rent increase may take effect during the fixed term unless mandatory law permits it and the parties make a valid written amendment. Any renewal increase remains subject to rent-control rules then in force.

4. Advance rent and security deposit

On signing or before turnover, the Lessee shall pay 1 month(s) of advance rent, equal to ₱10,000.00, and 2 month(s) of security deposit, equal to ₱20,000.00. The advance rent shall be applied to the first month of the term.

The unit is covered by rent control for 2025–2026. As Republic Act No. 9653 requires, the deposit shall be kept in a bank under the Lessor's account during the lease, and accrued interest shall be returned to the Lessee at expiry, subject to lawful deductions commensurate with unpaid rent, utilities, or actual damage attributable to the Lessee beyond ordinary wear and tear. The Lessor shall return the balance, with an itemized accounting, within thirty (30) days after the Lessee surrenders the Premises and the final utility bills are received.

5. Utilities and common charges

Lessee shall pay electricity charges. Lessee shall pay water charges. Lessor shall pay regular association dues. The Lessee remains responsible for services separately contracted in the Lessee's name and for consumption charges allocated to the Lessee under this Lease.

6. Repairs, care, and alterations

The Lessee shall use the Premises with the diligence of a good father of a family, keep it reasonably clean, promptly report damage or needed repairs, and be responsible for damage caused by the Lessee, approved residents, or guests beyond ordinary wear and tear. The Lessor shall make repairs necessary to keep the Premises suitable for residential use, except repairs made necessary by the Lessee's fault, subject to the Civil Code and other applicable law.

The Lessee shall not make structural changes, material alterations, or installations affecting building systems without the Lessor's prior written consent and any required building or governmental approval.

7. Access and inspections

Except in a genuine emergency, where immediate access is reasonably necessary to prevent injury or material damage, the Lessor shall give at least 24 hours' prior notice before entering at a reasonable time to inspect, make repairs, or show the Premises during the final sixty days of the term. Access shall not unreasonably interfere with the Lessee's peaceful enjoyment.

8. Occupancy, pets, assignment, and subletting

A pet may be kept only with the Lessor's prior written consent and subject to lawful building rules. The Lessee shall not assign this Lease, sublet any part of the Premises, or accept boarders or bedspacers without the Lessor's prior written consent. The Lessee remains responsible for the conduct of approved residents, invitees, and any person admitted by the Lessee.

Before you start.

Does a contract of lease need to be notarized in the Philippines?
Not to be valid between you and the other party, since a contract binds in whatever form it is made (Civil Code Art. 1356). But a lease longer than one year must be in writing and signed to be enforceable (Art. 1403), and a lease binds later buyers or other third persons only if it is recorded (Art. 1648). Notarizing makes it a public document, which is easier to prove.
How much does it cost to notarize a contract of lease?
We could not confirm a single nationwide amount. A notary may charge up to the maximum set by the Supreme Court, must post a fee schedule, and must issue a BIR-registered receipt, so ask for the fee before you proceed.
How do I write a contract of lease?
Name the lessor and lessee, describe the property, and state the term, monthly rent and due date, deposit and advance rent, who pays for repairs and utilities, and what happens when the lease ends. For homes renting for PHP 10,000 a month or less, rent control limits increases, advance rent, and deposits in 2026.
How much is the Residential Lease?
₱299, paid once. The interview and live preview are free, and the price covers the Word and PDF files, 30 days of revisions, and your account copy. There is no subscription. See all pricing →
How long does it take?
The guided interview has 6 steps and up to 43 questions. Some questions only appear when they apply to your situation, so you may answer fewer. You can read the document as it builds, and sign in to save a draft and finish later.
Do I need a notary?
Signed by the people involved. The people involved sign it, with witnesses or a notary where your signing checklist says one is needed. Notarizing a private document is often chosen anyway because it makes the document easier to prove. Your signing checklist lists the exact steps for your version.
Is it reviewed by a lawyer?
This template’s current status is: Independent Philippine lawyer review pending. LAW.PH is legal self-help software, not a law firm, and will not describe a document as lawyer-reviewed until an independent Philippine lawyer has approved this exact version.
Is there a free template?
Yes. The sample on this page is free to read and to download as an editable Word file, with no sign-in. It uses fictional names, dates, and amounts, so replace every one. The paid version is built from your own answers, checks them as you go, and includes the signing checklist for your exact situation. Download the free sample (.docx)
Can I change it after I buy it?
Yes. For 30 days you can create a separate revision draft, update your answers, and download the revised files at no extra charge. The version you originally bought is preserved unchanged.
Which law does it follow?
It is drafted under Philippine law and relies on 5 official sources, each listed above with the provisions used and the date it was last checked.
