What is an Affidavit of Undertaking?

An Affidavit of Undertaking is a written statement of facts that the person making it swears is true before a notary public or another officer authorized to give oaths.

Legal considerations

Formalities required. The undertaking must be specific, objectively possible, lawful, within actual authority, consistent with governing instruments, and accepted by the intended recipient; it cannot substitute for a required deed, settlement, waiver, official form, or admission review.

How it is signed

Sworn before a notary public. You sign in front of a notary public, who checks your identity and has you swear to the statements (a jurat). Do not sign it beforehand.

What it draws on

  • Civil Code
  • Supreme Court undertaking jurisprudence
  • 2004 Rules on Notarial Practice
  • Rules on eNotarization
  • Data Privacy Act
  • Receiving-agency rules

The exact provisions, with links to the official text, are listed under the Philippine law behind it.

How to complete your Affidavit of Undertaking

The guided interview takes you through 8 steps. The document updates as you answer, and some questions appear only when your earlier answers make them relevant.

  1. Step 1

    Confirm the undertaking fits

Use this for a specific future act or restraint. It is not a shortcut for a deed, settlement, waiver, confession, or agency-mandated form.

    Up to 4 questions
  2. Step 2

    Identify who can promise

A human affiant swears to the facts. Entity, business, or parental authority must be identified and must actually cover the promised act.

    Up to 9 questions
  3. Step 3

    Match the recipient's requirement

The recipient may require an official wording, attachments, deadline, approval, or separate agreement.

    Up to 6 questions
  4. Step 4

    Define the promise precisely

A strong undertaking says exactly what will happen, what counts as completion, and how the recipient can verify it.

    Up to 7 questions
  5. Step 5

    Set an objective deadline

Avoid “as soon as possible.” Use a fixed date, a measurable event plus a period, or a complete recurring schedule.

    Up to 9 questions
  6. Step 6

    Check legal boundaries

A generic affidavit should not quietly become a deed, settlement, rights waiver, confession, or poorly documented payment agreement.

    Up to 14 questions
  7. Step 7

    Define notice and lawful consequences

The affidavit should not invent penalties. Tie consequences to a verified rule or agreement and preserve reasonable notice and cure where allowed.

    Up to 9 questions
  8. Step 8

    Prepare the lawful jurat

The affiant signs and takes the oath through the selected notarial process. The notarial officer—not the generator—completes the jurat.

    Up to 5 questions

REPUBLIC OF THE PHILIPPINES )

MAKATI CITY ) S.S.

SWORN STATEMENT AND UNDERTAKING

I, Maria Luz Santos, Filipino, of legal age, single, residing at 100 Ayala Avenue, Makati City 1226, after having been duly sworn in accordance with law, depose and state:

1. I execute this Affidavit in my own name as the owner of the sole proprietorship doing business under the name and style Santos Print Shop, registered as follows: DTI Business Name Registration No. 1234567. I have read and understood the undertaking and have authority over the performance I promise.

2. The recipient is City Business Permits and Licensing Office, through Document Compliance Desk. The identified source and reason for this request are: Written deficiency notice dated August 25, 2026, reference BPLO-2026-8812, requesting the identified fire-safety certificate

3. The necessary background facts are: My renewal filing was received on August 20, 2026, but the current fire-safety certificate was not yet available when the other verified requirements were submitted.

4. I specifically and voluntarily undertake to do or refrain from the following: I will obtain the current fire-safety certificate through the proper issuing office and submit the genuine certificate to the Document Compliance Desk.

5. Completion means delivery or achievement of: One current fire-safety certificate accepted under the recipient's verified renewal checklist. I will perform through Personal filing by the affiant at the Document Compliance Desk against a dated receiving copy at or through City Business Permits and Licensing Office, not later than September 29, 2026.

6. Performance may begin upon lawful acceptance of this Affidavit, subject to the objective deadline above.

7. Known dependencies or prerequisites are: none presently identified beyond the recipient's ordinary lawful processing. I will not use an undisclosed third-party dependency to make the undertaking illusory.

8. Objective evidence of completion will be: Recipient-stamped receiving copy stating the certificate title, filing date, and transaction reference. I will deliver completion notice and evidence as follows: Email the stamped receiving copy to the verified BPLO compliance address within one business day after filing

9. This undertaking does not transfer ownership, create an undisclosed financial obligation, or substitute for a deed, payment agreement, settlement, or other purpose-specific instrument.

10. No existing agreement, order, or formal commitment has been identified as governing this undertaking. The recipient must not treat this affidavit as containing hidden or external terms.

11. Notices about delay, completion, or alleged non-compliance must be sent by Written notice by personal delivery or verified electronic mail to BPLO Document Compliance Desk and its verified official email address. Where lawful, I will have 5 calendar days from actual receipt of a sufficiently specific written notice to cure remediable non-performance.

12. Consequences are limited to this verified basis: This affidavit creates no penalty beyond consequences independently authorized by law, the recipient's governing rules, or a separately valid agreement. This Affidavit does not create an automatic criminal admission, confession of judgment, forfeiture, eviction, dismissal, fine, penalty, waiver, or entitlement not independently authorized by law or a valid identified agreement.

13. I understand that notarization records the oath and notarial act; it does not make an impossible or unlawful promise enforceable, validate a false fact, supply missing contractual consent or consideration, transfer property, waive protected rights, or guarantee the recipient's acceptance.

14. I have read and understood this complete Affidavit. The existing facts stated here are true and complete based on my personal knowledge and the records identified, and the future undertaking is specific, voluntary, lawful, and made in good faith.
