Legal considerations

Formalities required. The affiant must swear to personal facts before a duly commissioned notary; the receiving agency may require its own form.

How it is signed

Sworn before a notary public. You sign in front of a notary public, who checks your identity and has you swear to the statements (a jurat). Do not sign it beforehand.

What it draws on

  • 2004 Rules on Notarial Practice
  • Rules on eNotarization
  • Issuing-agency requirements

The exact provisions, with links to the official text, are listed under the Philippine law behind it.

How to complete your Affidavit of Loss

The guided interview takes you through 7 steps. The document updates as you answer, and some questions appear only when your earlier answers make them relevant.

  1. Step 1

    Confirm the affidavit fits

A sworn affidavit records the affiant's own truthful facts. It does not prove ownership, cancel an instrument, or force an issuer to replace it.

    Up to 3 questions
  2. Step 2

    Identify the affiant

The affiant is the human being who will personally swear to the facts, even when acting for an organization or another holder.

    Up to 8 questions
  3. Step 3

    Identify exactly what was lost

Use issuer records or a copy when available. Do not invent a serial number or expose a full financial-account number.

    Up to 17 questions
  4. Step 4

    State the loss chronology

Separate what the affiant remembers exactly from an honest estimate. Specific first-hand facts are more credible than legal conclusions.

    Up to 9 questions
  5. Step 5

    Document the search and reports

The affidavit should distinguish the search actually made, verified reports, and urgent protective steps that remain outstanding.

    Up to 10 questions
  6. Step 6

    Match the receiving organization

An issuer may require its own form, attachments, police report, publication, bond, court petition, fees, or personal filing.

    Up to 4 questions
  7. Step 7

    Prepare the lawful jurat

A jurat requires an oath and identity verification. The notarial officer—not the generator—completes the notarial certificate and register details.

    Up to 5 questions

Read the guide first.

Before you start.

Can I make my own affidavit of loss?
Yes. You can write it yourself or start from a template, but it only becomes a sworn affidavit when you sign it and take an oath in person before a notary public, showing a current government ID with your photo and signature. The office that asked for it may have its own form or extra requirements, so check with them first.
How do I get an affidavit of loss?
Prepare the affidavit stating what was lost, when and how it happened, how you searched for it, and why you need the affidavit. Then bring it unsigned to a notary public, sign it and swear to it in front of the notary, and show a valid ID. The notary records it in the notarial register.
What are the requirements for an affidavit of loss?
Usually the affidavit itself, a current government-issued ID with your photo and signature, and the notary's fee. Some offices ask for more: for a lost passport, the DFA currently lists a police report and an affidavit of loss, both in English. Check the office's current checklist or Citizen's Charter before you go.
How much is the Affidavit of Loss?
₱149, paid once. The interview and live preview are free, and the price covers the Word and PDF files, 30 days of revisions, and your account copy. There is no subscription. See all pricing →
How long does it take?
The guided interview has 7 steps and up to 56 questions. Some questions only appear when they apply to your situation, so you may answer fewer. You can read the document as it builds, and sign in to save a draft and finish later.
Do I need a notary?
Sworn before a notary public. You sign in front of a notary public, who checks your identity and has you swear to the statements (a jurat). Do not sign it beforehand. Your signing checklist lists the exact steps for your version.
Is it reviewed by a lawyer?
This template’s current status is: Independent Philippine lawyer review pending. LAW.PH is legal self-help software, not a law firm, and will not describe a document as lawyer-reviewed until an independent Philippine lawyer has approved this exact version.
Is there a free template?
Yes. The sample on this page is free to read and to download as an editable Word file, with no sign-in. It uses fictional names, dates, and amounts, so replace every one. The paid version is built from your own answers, checks them as you go, and includes the signing checklist for your exact situation. Download the free sample (.docx)
Can I change it after I buy it?
Yes. For 30 days you can create a separate revision draft, update your answers, and download the revised files at no extra charge. The version you originally bought is preserved unchanged.
Which law does it follow?
It is drafted under Philippine law and relies on 9 official sources, each listed above with the provisions used and the date it was last checked.
