What is a Deed of Sale — Motor Vehicle?

A Deed of Sale — Motor Vehicle is a deed that transfers ownership of, or another right in, property from one person to another.

Legal considerations

Heightened care. Never use an open deed; verify the registered owner, authority, OR/CR and physical identifiers, liens/alarms, payment, turnover, and prompt LTO transfer.

How it is signed

Acknowledged before a notary public. You sign, then appear before a notary public who checks your identity and confirms that you signed freely (an acknowledgment). This is the form usually needed for documents that will be registered.

What it draws on

  • Civil Code
  • Land Transportation and Traffic Code
  • New Anti-Carnapping Act
  • R.A. No. 12209
  • LTO transfer requirements
  • PNP-HPG clearance rules

The exact provisions, with links to the official text, are listed under the Philippine law behind it.

How to complete your Deed of Sale — Motor Vehicle

The guided interview takes you through 8 steps. The document updates as you answer, and some questions appear only when your earlier answers make them relevant.

  1. Step 1

    Confirm this sale fits

This route is for one existing privately registered vehicle sold absolutely for full payment. Different documents are needed for installment, dealer-retained-title, donation, estate, judicial, public-utility, repossession, missing-record, or disputed transactions.

    Up to 4 questions
  2. Step 2

Identify the registered owner and buyer

The seller must match the current CR or sign through documented authority. The buyer must be the actual named transferee, never a blank nominee.

    Up to 17 questions
  3. Step 3

    Match the exact vehicle

Copy registered details from the latest CR, then compare engine and chassis/VIN numbers against the physical vehicle and inspection records.

    Up to 16 questions
  4. Step 4

    Verify ownership and registration facts

A notarized deed does not cure a mismatched registered owner, missing authority, altered engine/chassis number, alarm, or marital-property defect.

    Up to 17 questions
  5. Step 5

    Record condition and inspection

Specific facts are more useful than a blanket “as-is” clause. Disclose defects, history, alterations, and odometer uncertainty honestly.

    Up to 10 questions
  6. Step 6

    Record full payment and turnover

Tie payment, receipt, possession, keys, records, operational custody, risk, and document delivery to provable events.

    Up to 14 questions
  7. Step 7

Plan the LTO and HPG transfer

The deed transfers the parties' rights, but prompt LTO registration protects both sides and third persons. Requirements and office practices change, so verify the current checklist before notarization.

    Up to 7 questions
  8. Step 8

    Set warranties and acknowledgment

The final deed preserves mandatory title and hidden-defect rules, records only supportable promises, and leaves the acknowledgment entirely to the authorized notarial officer.

    Up to 12 questions
